This resource provides a quick review of knowledgeable and informed consent. <\/p>\n\n\n\n<p>For a more comprehensive understanding, refer to the College\u2019s <a href=\"https:\/\/www.coto.org\/resources\/standard-for-consent-2023\/\" data-type=\"resource\" data-id=\"391\">Standard for Consent<\/a>.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n\n<div class=\"content-section-block has-fade-in-up  align wp-block-acf-content-section\" id=\"section-knowledgeable-consent\">\n    <div class=\"section-header \">\n        <h2>Knowledgeable Consent<\/h2>\n            <\/div>\n\n    <div class=\"content-section\" aria-hidden=\"false\">\n        <div class=\"acf-innerblocks-container\">\n\n<p>Under the <strong><em>Personal Health Information Protection Act, 2004<\/em><\/strong> (PHIPA), <strong>knowledgeable consent<\/strong> is a specific legal requirement for how a person&#8217;s health information can be collected, used, or shared. Knowledgeable consent emphasizes the importance of clients knowing what is happening with their personal health information. &nbsp;<\/p>\n\n\n\n<p><strong>Knowledgeable consent under PHIPA<\/strong> means:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>As the occupational therapist you are asking permission and obtaining the client\u2019s agreement, that you as the occupational therapist, clinic, or organization are allowed to collect, use, or share their personal health information.<\/li>\n\n\n\n<li>To obtain knowledgeable consent, the following should be explained to the client:<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>What<\/strong> personal health information is being collected or shared,<\/li>\n\n\n\n<li><strong>Who<\/strong> the personal health information is being shared with,<\/li>\n\n\n\n<li><strong>Why<\/strong> the personal health information is being shared or used (the purpose),<\/li>\n\n\n\n<li>The client has <strong>the right to ask questions and say yes or no.<\/strong><\/li>\n<\/ul>\n\n<\/div>\n    <\/div>\n<\/div>\n\n\n\n<div class=\"content-section-block has-fade-in-up  align wp-block-acf-content-section\" id=\"section-informed-consent\">\n    <div class=\"section-header \">\n        <h2>Informed Consent<\/h2>\n            <\/div>\n\n    <div class=\"content-section\" aria-hidden=\"false\">\n        <div class=\"acf-innerblocks-container\">\n\n<p>In Ontario, occupational therapists must obtain <strong>informed consent <\/strong>&nbsp;before providing any treatment or occupational therapy service.<\/p>\n\n\n\n<p><strong>Informed consent under the <em>Health Care Consent Act, 1996<\/em> (HCCA<\/strong>) means:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>As the occupational therapist you are asking permission and obtaining the client\u2019s agreement <strong>before providing any occupational therapy assessment, treatment, or consultation service<\/strong>.<\/li>\n\n\n\n<li>To obtain informed consent, the following should be explained to the client:\n<ul class=\"wp-block-list\">\n<li><strong>What<\/strong> the proposed treatment, procedure, or service is,<\/li>\n\n\n\n<li><strong>Why<\/strong> it is being recommended (the purpose and benefits),<\/li>\n\n\n\n<li><strong>Who<\/strong> is involved (any students, assistants, other providers),<\/li>\n\n\n\n<li><strong>What the risks<\/strong> are (including any serious or common side effects),<\/li>\n\n\n\n<li><strong>What alternatives<\/strong> are available (including doing nothing),<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>The client has<strong> the right to ask questions and say yes or no<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p><strong>Informed consent<\/strong> emphasizes that clients must have a clear understanding of the treatment itself &#8211; including risks and options &#8211; before agreeing to it.
