For more information about privacy legislation, refer to COTO\u2019s guidance document on <a href=\"https:\/\/www.coto.org\/resources\/privacy-legislation-and-occupational-therapy-practice\/\" data-type=\"resource\" data-id=\"1201\" target=\"_blank\" rel=\"noreferrer noopener\">Privacy Legislation and Occupational Therapy Practice<\/a>.<\/p>\n\n\n\n<p>As defined in PHIPA (s. 3 [1]), a \u201c<strong>health information custodian<\/strong>\u201d (HIC) is an individual or organization that has \u201ccustody or control of personal health information\u201d because of their professional role and\/or responsibilities. Under PHIPA, \u201c<strong>an agent<\/strong>\u201d is a person who is authorized to perform services or activities on behalf of a health information custodian (HIC).<\/p>\n\n\n\n<p>The following decision tree can help occupational therapists determine if they are a HIC or agent.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"747\" height=\"1001\" src=\"https:\/\/www.coto.org\/wp-content\/uploads\/2025\/09\/decision-tree-phi-hic-agent.png\" alt=\"\" class=\"wp-image-6756\" srcset=\"https:\/\/www.coto.org\/wp-content\/uploads\/2025\/09\/decision-tree-phi-hic-agent.png 747w, https:\/\/www.coto.org\/wp-content\/uploads\/2025\/09\/decision-tree-phi-hic-agent-640x858.png 640w\" sizes=\"auto, (max-width: 747px) 100vw, 747px\" \/><\/figure>\n\n\n\n\n<div class=\"content-section-block has-fade-in-up  align wp-block-acf-content-section\" id=\"section-process-description\">\n    <div class=\"section-header \">\n        <h2>Process Description<\/h2>\n            <\/div>\n\n    <div class=\"content-section\" aria-hidden=\"false\">\n        <div class=\"acf-innerblocks-container\">\n\n<h3 class=\"wp-block-heading has-medium-font-size\"><strong>Question 1<\/strong><\/h3>\n\n\n\n<p>Do you collect, use, or disclose <strong>personal health information<\/strong> (PHI) in the course of providing occupational therapy or supporting other health care services?<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>If<strong> yes<\/strong>, proceed to Question 2.<\/li>\n\n\n\n<li>If<strong> no, you are neither a health information custodian (HIC) nor an agent<\/strong>.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading has-medium-font-size\"><strong>Question 2<\/strong><\/h3>\n\n\n\n<p>Do you work for or on behalf of a health organization, clinic, or health care provider, and follow their instructions and policies regarding how to handle personal health information (PHI)?<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>If <strong>yes<\/strong>, proceed to Question 3.<\/li>\n\n\n\n<li>If <strong>no<\/strong>, skip to Question 4.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading has-medium-font-size\"><strong>Question 3<\/strong><\/h3>\n\n\n\n<p>Do you have independent authority over how personal health information (PHI) is collected, used, or disclosed (for example: policies, storage, access)?<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>If <strong>yes<\/strong>, <strong>you are likely the health information custodian (HIC).<\/strong><\/li>\n\n\n\n<li>If <strong>no<\/strong>, <strong>you are likely the agent<\/strong>.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading has-medium-font-size\"><strong>Question 4<\/strong><\/h2>\n\n\n\n<p>Do you work in your own private practice or as independent contractor, where you store and respond to clients requesting access or correction to the record?<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>If <strong>yes<\/strong>, <strong>you are likely the health information custodian (HIC).<\/strong><\/li>\n\n\n\n<li>If <strong>no<\/strong>, proceed to Question 5.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading has-medium-font-size\"><strong>Question 5<\/strong><\/h3>\n\n\n\n<p>Are you contracted or employed by a health information custodian (HIC) to perform services involving PHI?<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>You are likely the agent<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p class=\"has-black-color has-off-white-background-color has-text-color has-background has-link-color wp-elements-f7bb4402dae27d1f6f3469791a20d58b\"><strong>Note: <\/strong>Other privacy laws may apply depending on whether <br>(1) the services provided (such as workplace evaluations or independent assessments) are considered healthcare or non- healthcare; and <br>(2) the type of organization through which services are funded or delivered (municipal, provincial, or federal government or services to Indigenous communities).
