That\u2019s part of many necessary exams and therapies. When that happens, you should expect the occupational therapist to tell you what he\/she is going to do, to ask permission to touch you and to treat you with respect. Such physical contact is very different from touching you in a manner that\u2019s not needed for treatment or assessment, such as in a sexual rather than a therapeutic way.<\/li>\n\n\n\n<li><strong>Behaviour or remarks of a sexual nature by the occupational therapist towards their client.&nbsp;<\/strong>That can include saying something sexually suggestive; asking you on a date; making sexual comments on your appearance or clothes; commenting about your sexual relationships; making sexually insulting or offensive comments; or giving unwanted attention (like kissing or hugging). It does not include behaviour or remarks that are necessary for the occupational therapist to do his or her work.<\/li>\n<\/ul>\n\n<\/div>\n            <\/div>\n        <\/div><!-- .accordion-content -->\n    <\/div><!-- .accordion-details -->\n\n\n\n\n    \n\n    <div class=\"accordion-details has-fade-in-up block_6b4b7d47c59f61dddeb1074199db9de0\" data-open=\"false\" >\n        <div class=\"accordion-summary\" id=\"summary-block_6b4b7d47c59f61dddeb1074199db9de0\" aria-controls=\"content-block_6b4b7d47c59f61dddeb1074199db9de0\" aria-expanded=\"false\" tabindex=\"0\">\n            <div class=\"accordion-title\" >How do I know if I am an occupational therapist&#8217;s client?<\/div>\n            <div class=\"accordion-toggle\">\n                <svg aria-hidden=\"true\" width=\"27\" height=\"27\" viewBox=\"0 0 100 100\" xmlns=\"http:\/\/www.w3.org\/2000\/svg\">\n                <rect x=\"45\" y=\"20\" width=\"8\" height=\"60\" fill=\"black\"\/>\n                    <rect x=\"20\" y=\"45\" width=\"60\" height=\"8\" fill=\"black\"\/>\n                <\/svg>\n            <\/div>\n        <\/div><!-- .accordion-summary -->\n        <div class=\"accordion-content\" id=\"content-block_6b4b7d47c59f61dddeb1074199db9de0\" aria-labelledby=\"summary-block_6b4b7d47c59f61dddeb1074199db9de0\" >\n            <div >\n                <div class=\"accordion-content-inner\">\n\n<p>In the context of sexual abuse, you are the client of an occupational therapist if any of the following conditions exist:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the occupational therapist provided you with a health care service and charged or received from you, or from a third party on your behalf, payment for this service;<\/li>\n\n\n\n<li>the occupational therapist has contributed to your health record or file;<\/li>\n\n\n\n<li>you consented to a health care service recommended by the occupational therapist.<\/li>\n<\/ul>\n\n\n\n<p>You will not be considered a client in the context of sexual abuse if all of the following conditions are satisfied:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>a sexual relationship already existed between you and the occupational therapist when the occupational therapist provided you with the health care service;<\/li>\n\n\n\n<li>the occupational therapist provided the health care service to you in an emergency circumstance or in circumstances where the service provided was minor in nature;<\/li>\n\n\n\n<li>the occupational therapist took reasonable steps to transfer your care to another health professional or there was no reasonable opportunity to transfer your care to another health professional.<\/li>\n<\/ul>\n\n<\/div>\n            <\/div>\n        <\/div><!-- .accordion-content -->\n    <\/div><!-- .accordion-details -->\n\n\n\n\n    \n\n    <div class=\"accordion-details has-fade-in-up block_8208f9d504d2c2a8664a79a48f03aa66\" data-open=\"false\" >\n        <div class=\"accordion-summary\" id=\"summary-block_8208f9d504d2c2a8664a79a48f03aa66\" aria-controls=\"content-block_8208f9d504d2c2a8664a79a48f03aa66\" aria-expanded=\"false\" tabindex=\"0\">\n            <div class=\"accordion-title\" >I\u2019m not sure if I was abused. A staff member can help you<\/strong>&nbsp;understand the standards of practice that occupational therapists must follow, including their ethical, regulatory and clinical expectations.<\/p>\n\n\n\n<p>You may also contact the College\u2019s investigation staff to discuss the complaints process. If you wish, you do not have to identify yourself. In any of these instances, client consent is not relevant. Often, incidents of sexual abuse are not isolated. By telling the College what happened, you may also be&nbsp;<strong>helping others who have been or may be abused<\/strong>. Reporting abuse protects the public. The College must tell the occupational therapist your name so that he or she has a chance to respond to the allegations as part of the investigation. However, to protect your privacy, your personal information will not be made public.<\/p>\n\n<\/div>\n            <\/div>\n        <\/div><!-- .accordion-content -->\n    <\/div><!-- .accordion-details -->\n\n\n\n\n    \n\n    <div class=\"accordion-details has-fade-in-up block_1330481f31cd369bc5ad5b4d9ab694ce\" data-open=\"false\" >\n        <div class=\"accordion-summary\" id=\"summary-block_1330481f31cd369bc5ad5b4d9ab694ce\" aria-controls=\"content-block_1330481f31cd369bc5ad5b4d9ab694ce\" aria-expanded=\"false\" tabindex=\"0\">\n            <div class=\"accordion-title\" >Can occupational therapists practice when they\u2019re accused of sexual abuse?<\/div>\n            <div class=\"accordion-toggle\">\n                <svg aria-hidden=\"true\" width=\"27\" height=\"27\" viewBox=\"0 0 100 100\" xmlns=\"http:\/\/www.w3.org\/2000\/svg\">\n                <rect x=\"45\" y=\"20\" width=\"8\" height=\"60\" fill=\"black\"\/>\n                    <rect x=\"20\" y=\"45\" width=\"60\" height=\"8\" fill=\"black\"\/>\n                <\/svg>\n            <\/div>\n        <\/div><!-- .accordion-summary -->\n        <div class=\"accordion-content\" id=\"content-block_1330481f31cd369bc5ad5b4d9ab694ce\" aria-labelledby=\"summary-block_1330481f31cd369bc5ad5b4d9ab694ce\" >\n            <div >\n                <div class=\"accordion-content-inner\">\n\n<p><strong>Until there\u2019s an actual decision regarding the sexual abuse (called a finding), they can<\/strong>. However,&nbsp;<strong>there are exceptions<\/strong>. The Inquiries, Complaints and Reports Committee (ICRC) investigates all complaints brought to the College\u2019s attention, including those involving possible sexual abuse.<\/p>\n\n\n\n<p>The ICRC may receive information that justifies a decision to suspend a registered occupational therapist. That\u2019s called an \u201cinterim order\u201d, and means the occupational therapist cannot practice while the investigation is ongoing. Through an interim order, the ICRC can also impose restrictions on the occupational therapist\u2019s practice.<\/p>\n\n<\/div>\n            <\/div>\n        <\/div><!-- .accordion-content -->\n    <\/div><!-- .accordion-details -->\n\n\n\n\n    \n\n    <div class=\"accordion-details has-fade-in-up block_036b167ea6d242ab20f9c8046291972a\" data-open=\"false\" >\n        <div class=\"accordion-summary\" id=\"summary-block_036b167ea6d242ab20f9c8046291972a\" aria-controls=\"content-block_036b167ea6d242ab20f9c8046291972a\" aria-expanded=\"false\" tabindex=\"0\">\n            <div class=\"accordion-title\" >Does the College contact the police when there has been an allegation of sexual abuse?  <\/div>\n            <div class=\"accordion-toggle\">\n                <svg aria-hidden=\"true\" width=\"27\" height=\"27\" viewBox=\"0 0 100 100\" xmlns=\"http:\/\/www.w3.org\/2000\/svg\">\n                <rect x=\"45\" y=\"20\" width=\"8\" height=\"60\" fill=\"black\"\/>\n                    <rect x=\"20\" y=\"45\" width=\"60\" height=\"8\" fill=\"black\"\/>\n                <\/svg>\n            <\/div>\n        <\/div><!-- .accordion-summary -->\n        <div class=\"accordion-content\" id=\"content-block_036b167ea6d242ab20f9c8046291972a\" aria-labelledby=\"summary-block_036b167ea6d242ab20f9c8046291972a\" >\n            <div >\n                <div class=\"accordion-content-inner\">\n\n<p>No. The College does not automatically report allegations of sexual abuse to the police. If you or someone you know feels they have been sexually abused by an occupational therapist, you have the right to report your concerns both to the College and to the police. A police investigation into allegations of sexual abuse is separate and distinct to any investigation carried out by the College and could result in a criminal conviction against the abusing occupational therapist. All allegations are taken seriously and thoroughly investigated. Through an interim order, the College&#8217;s Inquiries, Complaints &amp; Reports Committee can impose restrictions on the occupational therapist\u2019s practice during an investigation. Any restrictions placed on the occupational therapist&#8217;s license (registration) will be made publicly available on the&nbsp;<strong><a href=\"https:\/\/otportal.coto.org\/Public-Register-Search-Custom\/\" target=\"_blank\" rel=\"noreferrer noopener\">List of Registered Occupational Therapists<\/a><\/strong>.<\/p>\n\n<\/div>\n            <\/div>\n        <\/div><!-- .accordion-content -->\n    <\/div><!-- .accordion-details -->\n\n\n\n\n    \n\n    <div class=\"accordion-details has-fade-in-up block_11fa0648a0594bcce74f3422256a2d12\" data-open=\"false\" >\n        <div class=\"accordion-summary\" id=\"summary-block_11fa0648a0594bcce74f3422256a2d12\" aria-controls=\"content-block_11fa0648a0594bcce74f3422256a2d12\" aria-expanded=\"false\" tabindex=\"0\">\n            <div class=\"accordion-title\" >What happens to an occupational therapist who is found to have committed sexual abuse?<\/div>\n            <div class=\"accordion-toggle\">\n                <svg aria-hidden=\"true\" width=\"27\" height=\"27\" viewBox=\"0 0 100 100\" xmlns=\"http:\/\/www.w3.org\/2000\/svg\">\n                <rect x=\"45\" y=\"20\" width=\"8\" height=\"60\" fill=\"black\"\/>\n                    <rect x=\"20\" y=\"45\" width=\"60\" height=\"8\" fill=\"black\"\/>\n                <\/svg>\n            <\/div>\n        <\/div><!-- .accordion-summary -->\n        <div class=\"accordion-content\" id=\"content-block_11fa0648a0594bcce74f3422256a2d12\" aria-labelledby=\"summary-block_11fa0648a0594bcce74f3422256a2d12\" >\n            <div >\n                <div class=\"accordion-content-inner\">\n\n<p>If, following a hearing, a panel of the College\u2019s Discipline Committee finds that an occupational therapist has sexually abused a client the Committee will impose the appropriate penalty, which may include revocation of the occupational therapist\u2019s registration (license).<strong>&nbsp;A discipline hearing is the most serious proceeding that a regulated health professional can face<\/strong>.<\/p>\n\n\n\n<p>Penalties can include&nbsp;<strong>reprimands and fines as well as the ability to limit, suspend or revoke the Occupational Therapist\u2019s registration (license)<\/strong>.<\/p>\n\n<\/div>\n            <\/div>\n        <\/div><!-- .accordion-content -->\n    <\/div><!-- .accordion-details -->\n\n\n\n\n    \n\n    <div class=\"accordion-details has-fade-in-up block_ba212b0624158a47d8b9522dcaf65906\" data-open=\"false\" >\n        <div class=\"accordion-summary\" id=\"summary-block_ba212b0624158a47d8b9522dcaf65906\" aria-controls=\"content-block_ba212b0624158a47d8b9522dcaf65906\" aria-expanded=\"false\" tabindex=\"0\">\n            <div class=\"accordion-title\" >When must the College revoke an occupational therapist\u2019s registration (license) for committing sexual abuse?<\/div>\n            <div class=\"accordion-toggle\">\n                <svg aria-hidden=\"true\" width=\"27\" height=\"27\" viewBox=\"0 0 100 100\" xmlns=\"http:\/\/www.w3.org\/2000\/svg\">\n                <rect x=\"45\" y=\"20\" width=\"8\" height=\"60\" fill=\"black\"\/>\n                    <rect x=\"20\" y=\"45\" width=\"60\" height=\"8\" fill=\"black\"\/>\n                <\/svg>\n            <\/div>\n        <\/div><!-- .accordion-summary -->\n        <div class=\"accordion-content\" id=\"content-block_ba212b0624158a47d8b9522dcaf65906\" aria-labelledby=\"summary-block_ba212b0624158a47d8b9522dcaf65906\" >\n            <div >\n                <div class=\"accordion-content-inner\">\n\n<p>If, after a hearing before a panel of the College\u2019s Discipline Committee, an occupational therapist is found to have committed professional misconduct by sexually abusing a client, the panel, in addition to any other action it might take, must reprimand the occupational therapist and revoke the occupational therapist\u2019s registration (license) if the sexual abuse consisted of any of the following acts:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Sexual intercourse;<\/li>\n\n\n\n<li>Genital to genital, genital to anal, oral to genital or oral to anal contact;<\/li>\n\n\n\n<li>Masturbation of the occupational therapist by, or in the presence of, the client;<\/li>\n\n\n\n<li>Masturbation of the client by the occupational therapist;<\/li>\n\n\n\n<li>Encouraging the client to masturbate in the presence of the occupational therapist;
