That includes patients, clients, their family members, caregivers, colleagues of an occupational therapist, an employer and others.<\/p>\n\n\n\n<p>If there is a concern about an occupational therapist, contact us:<\/p>\n\n\n\n<p>Toronto: 416-214-1177 x220<br>Toll-free: 1-800-890-6570 x220<br>Email:\u00a0<a href=\"mailto:investigations@coto.org\">investigations@coto.org<\/a><\/p>\n\n\n\n<p>When investigating and reviewing concerns about occupational therapists, the complaints committee looks at the nature of the issue and the possibility of harm to the client or patient.<\/p>\n\n<\/div>\n    <\/div>\n<\/div>\n\n\n\n<div class=\"content-section-block has-fade-in-up  align wp-block-acf-content-section\" id=\"section-how-does-the-complaints-committee-make-decisions-to-protect-clients-and-patients-from-harm\">\n    <div class=\"section-header \">\n        <h2>How does the complaints committee make decisions to protect clients and patients from harm?<\/h2>\n            <\/div>\n\n    <div class=\"content-section\" aria-hidden=\"false\">\n        <div class=\"acf-innerblocks-container\">\n\n<p>The complaints committee uses a risk assessment framework. A framework is a system for evaluating the risk posed by an occupational therapist to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the public<\/li>\n\n\n\n<li>client care or safety<\/li>\n\n\n\n<li>the reputation of the occupational therapy profession.<\/li>\n<\/ul>\n\n\n\n<p><strong>All complaints are taken seriously and investigated.<\/strong><\/p>\n\n\n\n<p>Using a framework helps make sure decisions are consistent. Sometimes, a decision will be made that will not satisfy the person who complained. We understand the process can be frustrating.<\/p>\n\n\n\n<p class=\"has-x-small-font-size\"><strong>Note:<\/strong>&nbsp;The complaints committee uses this risk framework when appropriate. An occupational therapist might have a mental or physical condition or disorder that interferes with their ability to practise as expected. That\u2019s called \u201cincapacity\u201d. Such issues are assessed differently.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\" style=\"margin-top:var(--wp--preset--spacing--large);margin-bottom:0\"><img loading=\"lazy\" decoding=\"async\" width=\"248\" height=\"178\" src=\"https:\/\/www.coto.org\/wp-content\/uploads\/2024\/11\/risk-levels.png\" alt=\"\" class=\"wp-image-943\"\/><\/figure>\n\n<\/div>\n    <\/div>\n<\/div>\n\n\n\n<div class=\"content-section-block has-fade-in-up  align wp-block-acf-content-section\" id=\"section-what-factors-does-the-complaints-committee-consider-when-making-decisions-about-risk\">\n    <div class=\"section-header \">\n        <h2>What factors does the complaints committee consider when making decisions about risk?<\/h2>\n            <\/div>\n\n    <div class=\"content-section\" aria-hidden=\"false\">\n        <div class=\"acf-innerblocks-container\">\n\n<p>Each case is different. The complaints committee considers all information when deciding what to do about an occupational therapist\u2019s conduct or practice.<\/p>\n\n\n\n<div class=\"wp-block-group has-off-white-background-color has-background has-global-padding is-layout-constrained wp-container-core-group-is-layout-8217c53c wp-block-group-is-layout-constrained\" style=\"padding-top:var(--wp--preset--spacing--medium);padding-right:var(--wp--preset--spacing--medium);padding-bottom:var(--wp--preset--spacing--medium);padding-left:var(--wp--preset--spacing--medium)\">\n<p><strong>As part of its duty to protect the public, the complaints committee considers a series of questions, such as:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Do the concerns pose a direct risk to client care or safety?<\/li>\n\n\n\n<li>Has the occupational therapist (OT) been honest about the situation?<\/li>\n\n\n\n<li>Has the OT gained financially from the situation under investigation?<\/li>\n\n\n\n<li>Is this situation likely to happen again?<\/li>\n\n\n\n<li>Is there evidence supporting the concerns?<\/li>\n\n\n\n<li>Does the OT understand how the client is affected?<\/li>\n\n\n\n<li>Does the OT understand how their colleagues, employers and others are affected?<\/li>\n\n\n\n<li>Does the OT understand they have failed to meet College standards and expectations?<\/li>\n\n\n\n<li>Does the OT understand why the concerns are under investigation?<\/li>\n\n\n\n<li>Has the OT volunteered to take steps to make the situation better?<\/li>\n\n\n\n<li>Has the OT cooperated with the investigation?<\/li>\n\n\n\n<li>How long has the OT been practising?<\/li>\n\n\n\n<li>Does the OT regret what happened?<\/li>\n\n\n\n<li>Does the OT have a history of complaints or concerns on file with the College?<\/li>\n<\/ul>\n\n\n\n<p><strong>Together, the answers can help establish risk levels, from &#8216;none&#8217; to &#8216;high&#8217;.<\/strong><\/p>\n\n\n\n<p>This information will help the complaints committee make its decision.<\/p>\n\n\n\n<p>If the level of risk is low to moderate, decisions are intended to be educational and corrective.<\/p>\n\n\n\n<p>If the level of risk is high, decisions are more serious.<\/p>\n<\/div>\n\n<\/div>\n    <\/div>\n<\/div>\n\n\n\n<div class=\"content-section-block has-fade-in-up  align wp-block-acf-content-section\" id=\"section-what-are-the-decisions-when-there-is-no-risk-to-the-public\">\n    <div class=\"section-header \">\n        <h2>What are the decisions when there is no risk to the public?<\/h2>\n            <\/div>\n\n    <div class=\"content-section\" aria-hidden=\"false\">\n        <div class=\"acf-innerblocks-container\">\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-28f84493 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:75%\">\n<h4 class=\"wp-block-heading\">Take No Action<\/h4>\n\n\n\n<p>The complaints committee might decide the concerns don\u2019t pose a risk to the public, or that there\u2019s no evidence to support the concerns. They include terms, like requiring the occupational therapist to practise under another occupational therapist&#8217;s supervision for a defined period or to take a course on a topic like ethics.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Specified Continuing Education or Remedial Programs (SCERPs)<\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>SCERPs can include things like courses or assessment by a peer, to educate the occupational therapist about professional standards and expectations.<\/li>\n\n\n\n<li>The goal is to improve or change the occupational therapist\u2019s practice where there are concerns and ensure that similar concerns don\u2019t repeat.<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">Caution-in-Person<\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The occupational therapist has to appear in front of a panel of the complaints committee at the College.<\/li>\n\n\n\n<li>The panel gives a verbal caution to instruct the occupational therapist about appropriate conduct and practice, and emphasize the seriousness of the issues.<\/li>\n\n\n\n<li>This way, the committee can directly educate the occupational therapist on the level of ethics, judgement and professional integrity expected from all occupational therapists.<\/li>\n<\/ul>\n<\/div>\n\n\n\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:25%\">\n<figure class=\"wp-block-image aligncenter size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"121\" height=\"95\" src=\"https:\/\/www.coto.org\/wp-content\/uploads\/2024\/11\/moderate-risk.png\" alt=\"\" class=\"wp-image-946\"\/><\/figure>\n<\/div>\n<\/div>\n\n<\/div>\n    <\/div>\n<\/div>\n\n\n\n<div class=\"content-section-block has-fade-in-up  align wp-block-acf-content-section\" id=\"section-what-are-the-decisions-when-the-risk-to-the-public-is-high\">\n    <div class=\"section-header \">\n        <h2>What are the decisions when the risk to the public is high?<\/h2>\n            <\/div>\n\n    <div class=\"content-section\" aria-hidden=\"false\">\n        <div class=\"acf-innerblocks-container\">\n\n<div class=\"wp-block-columns is-layout-flex wp-container-core-columns-is-layout-28f84493 wp-block-columns-is-layout-flex\">\n<div class=\"wp-block-column is-layout-flow wp-block-column-is-layout-flow\" style=\"flex-basis:75%\">\n<h4 class=\"wp-block-heading\">Undertaking with Restrictions<\/h4>\n\n\n\n<div class=\"wp-block-group has-global-padding is-layout-constrained wp-block-group-is-layout-constrained\" style=\"margin-top:var(--wp--preset--spacing--medium);margin-bottom:var(--wp--preset--spacing--medium)\">\n<p>If a temporary order is issued, the matter is investigated and a decision issued as quickly as is reasonably possible.<\/p>\n\n\n\n<p>When the complaints committee thinks serious measures must be put in place to protect the public, the committee can put limits on an occupational therapist\u2019s practice that may include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>an agreement to only practise in the presence of a practice supervisor, or<\/li>\n\n\n\n<li>an agreement to only resume practising after working with a College-trained occupational therapist to address identified concerns.<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">Referral to Discipline Committee<\/h4>\n\n\n\n<p>&nbsp;A referral results in a formal hearing, where the College Discipline Committee can impose a series of disciplinary measures.<\/p>\n\n\n\n<p>Details of a referral to discipline, and a copy of the notice of the hearing, are posted on the occupational therapist\u2019s public profile on the&nbsp;<a href=\"https:\/\/otportal.coto.org\/Public-Register-Search-Custom\/\" target=\"_blank\" rel=\"noreferrer noopener\">List of Registered Occupational Therapists<\/a>.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Undertaking to Resign and Agree Never to Practise Again<\/h4>\n\n\n\n<p>This usually happens when the complaints committee:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>determines that a referral to the Discipline Committee is warranted; and<\/li>\n\n\n\n<li>the College would seek a serious penalty at the discipline hearing, up to taking away a license to practise<\/li>\n<\/ul>\n\n\n\n<p>An occupational therapist would offer to enter into this agreement to avoid the discipline hearing. This information is posted on the occupational therapist\u2019s public profile&nbsp;on the&nbsp;<a href=\"https:\/\/otportal.coto.org\/Public-Register-Search-Custom\/\" target=\"_blank\" rel=\"noreferrer noopener\">List of Registered Occupational Therapists<\/a>.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Temporary Order<\/h4>\n\n\n\n<p>The complaints committee can make an order restricting or suspending an occupational therapist\u2019s practice at any time (sometimes as soon as the College receives a complaint).
